5.  Additional terms:

a.  State of Health.  This dog has been found to be in good health at time of sale.  The dog has been properly wormed and inoculated prior to sale, and record of such accompanies dog.

b.  Veterinary Examination.  This dog should be examined by Buyer’s licensed veterinarian, ideally within seventy-two (72) hours of receipt.  If this veterinarian determines the dog to be ill, or for any reason the dog is unacceptable, Buyer may return the dog for a full refund under the attached warranty, provided it is in the same condition as at the time of purchase.  If the dog is returned due to illness, a verified letter from the veterinarian is required.  This includes death or illness from any health condition deemed present prior to removal from Seller premises.

c. Canine Hip Dysplasia (CHD). Seller represents this Dog’s parents have been certified by the Orthopedic Foundation for Animals (OFA) as having good or excellent hip conformation. However, because of the nature of this disease, CHD can occur in dogs whose known ancestors were not dysplastic. Seller accordingly makes no warranty, expressed or implied, that this Dog will not develop CHD or that it will be certifiable as having excellent, good, or fair hip conformation. At the Buyer’s request, the Seller will choose to either replace the Dog or refund half of the purchase price if the OFA determines the Dog suffers from mild, moderate, or severe hip dysplasia within 26 months of purchase. If the OFA determines that the Dog suffers from mild, moderate, or severe hip dysplasia, the Buyer will have the animal x-rayed a second time by a veterinarian known in the medical community as being skilled at hip x-rays within 18 months. Buyer will forward this second set of x-rays to the breeder for ultimate submission to the OFA. If the second set of x-rays is certified as dysplastic and the Buyer requests, Seller will either refund half the purchase price or replace the animal as specified below.  In order for a replacement or refund right to vest in Seller, Buyer must have this animal’s hip x-rays certified by the OFA between the ages of 24 and 30 months. Buyer is also responsible for exhibiting reasonable care, including proper feeding, conditioning, and weight management, during this Dog’s lifetime but particularly up until 18 months of age. This warranty is void if the Dog was bred prior to receiving a final hip clearance of fair, good, or excellent, or was spayed or neutered prior to 24 months of age without Seller’s written permission, or fed Kibble labeled as Puppy Food. Under no circumstances will Seller be responsible for payment for any medical treatment for a dog demonstrating CHD at any time.

d. Ownership. Seller warrants and agrees she is the lawful owner of the dog, the dog is free of all encumbrances, she has the right to sell the same, and she will warrant and defend the title to the dog from all lawful claims and demands.

e.  Registration.  Seller reccommends that the Buyer register this dog within 6 months after the puppy is picked up at Seller’s and is encouraged to use the kennel name, Sliding Creeks, as the first word of the dog’s registered name.

f.  Proper Care.  Buyer agrees to provide good and proper care of this dog and that the dog will reside in the home of the Buyer.  Such care includes providing adequate housing and shade, a safe (preferably fenced) exercise area, and proper and sufficient feeding.  Buyer will provide proper veterinary care throughout the dog’s lifetime.  Buyer also agrees to the following preventive care.

(1)  proper not excessive nutrition.  Buyer will feed this dog a “premium” adult dog food or a well-balanced natural diet.  If the Buyer is feeding kibble, Buyer will feed food formulated for “adults”/”All Life Stages”. In addition, Buyer will take extreme caution to not overfeed this dog nor allow it to become overweight.

(2)  proper daily exercise to maintain the dog in good condition but no forced exercise, such as jogging or biking on leash, until the dog is at least 18 months of age; and,

(3)  avoidance of stress injuries, such as not allowing the dog to jump from or over heights taller than itself at the shoulder until at least 18 months of age.

g.  Sale Prohibitions.  Buyer is not acting as an agent in the purchase of this dog.  Buyer agrees neither this dog, nor any progeny of this dog, shall be used for purposes of vivisection or research.  Buyer also agrees neither this dog, nor any progeny of this dog, shall be sold by or through any commercial broker or wholesale establishment, any chain store, catalog sales house, pet store, or “puppy mill.”

h. Return of Dog.  Buyer guarantees Seller the right of first refusal if the dog is to be sold or disposed of in any way.  If Seller does not wish to acquire the dog, Seller will assist Buyer in placing the dog.  Although Seller will take this dog back at any time during its lifetime, this does not imply the Seller will refund the animal’s full purchase price.  If Seller does take this dog back for placement in another home, the Buyer must return the dog to Seller along with a duly executed American Kennel Club document transferring entirely Buyer’s ownership interest in the dog to Seller.  Buyer may not place dog in a new home without first discussing the placement with Seller and Buyer will promptly notify Seller of new owner’s name, address, and telephone number.

i. Guarantees.  No guarantees, express or implied, are given by the Seller, and all dogs are sold and delivered in an “as is” condition, except as expressly and specifically set forth herein and in the attached warranty.  Seller will be liable to the extent stated in this agreement and the attached warranty only, and will not be responsible for any expenses incurred for any reason following the sale, unless specifically and expressly excepted by written agreement.
